Welcome to Nettie’s Country Foods Inc. (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website www.nettiesbakery.com (the “Site”) and your purchase of products from us. By accessing or using our Site, you agree to these Terms.

2. Products and Orders

  • We sell baked goods, including but not limited to brownies.

  • Orders can be placed as guests or by creating an account.

  • We reserve the right to refuse or cancel any order for suspicion of fraud, inability to fulfill, or other reasons.

  • Prices and availability are subject to change without notice.

  • We do not currently have minimum or maximum order quantities.


3. Payment and Billing

  • We accept payments via PayPal and Shopify Payments, which include major credit and debit cards.

  • Applicable taxes are calculated based on the shipping address and are not included in the listed prices.

  • You agree to pay all charges incurred by your account and authorize us to charge your payment method.

  • The refund guarantee shown throughout our website is limited to the purchase price of one standard box of brownie bites, regardless of order size.

  • If you have a billing dispute, please contact us before initiating a chargeback. Chargebacks without prior communication may result in suspension of your account or collection actions.


4. Shipping and Delivery

  • We ship all orders within the United States using UPS Ground, FedEx 2-Day, or USPS Priority Mail via ShipStation.

  • Most orders arrive within two business days after shipment.

  • Shipping costs are displayed at checkout and on our Shipping Information page.

  • We are not responsible for delays caused by carriers but will work with you to resolve any issues.


5. Returns and Refunds

  • Due to the perishable nature of our products, we do not accept returns.

  • If you are not satisfied with your purchase, please contact us within 7 days of delivery with photos or other evidence of product issues.

  • We offer refunds limited to the cost of one standard box of brownie bites per order.

  • Abuse of our refund policy (e.g., multiple refund requests on large orders) may result in refusal of refunds or account suspension.


6. User Conduct and Content

  • Accounts are optional and not required to make purchases.

  • Customers may leave product reviews, which we reserve the right to moderate.

  • Reviews containing profanity, hate speech, or malicious content may be removed at our discretion.

  • Users agree not to misuse the Site or submit inappropriate content.


7. Intellectual Property

  • All content on the Site, including text, images, logos, and designs, are the property of Nettie’s Country Foods Inc. or our licensors.

  • You may not use any content without our express written permission.


8. Limitation of Liability

  • To the fullest extent permitted by law, Nettie’s Country Foods Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products.

  • We do not guarantee uninterrupted access to the Site.

  • Our liability, if any, shall not exceed the amount paid for the product or service at issue.


9. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

  • Any disputes arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration in Suffolk County, New York, in accordance with the rules of the American Arbitration Association.

  • By agreeing to these Terms, you waive your right to a trial by jury or to participate in a class action.

  • We may update these Terms from time to time. The updated version will be posted on the Site with an updated effective date.

  • Continued use of the Site after changes constitutes acceptance of the new Terms.

Mobile Terms of Service

The Nettie's Country Foods Inc. mobile message service (the "Service") is operated by Nettie's Country Foods Inc. (“Nettie's Country Foods Inc.”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Nettie's Country Foods Inc. SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Nettie's Country Foods Inc. through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Nettie's Country Foods Inc. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18776936461 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Nettie's Bakery mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
